Victim Killed During Struggle

According to police, 60-year-old Miguel Stemley had just dropped off passengers near Bienville and Burgundy streets on Oct. 9 when he was targeted in an attempted carjacking.

Authorities say a struggle ensued, during which Stemley’s vehicle flipped over, trapping him underneath. He was taken to a hospital but later died from his injuries.

Suspects and Charges

The two defendants, 21-year-old Brandon Joseph and 19-year-old Angel Martinez, have remained in custody since their arrests shortly after the incident.

Joseph is charged with second-degree murder. Martinez faces charges as a principal to second-degree murder and as an accessory after the fact. If convicted, both could face life in prison.

Allegations Against Martinez

Investigators allege Martinez was nearby during the incident and later sent a text message referencing the attempted carjacking and crash.

Defense Arguments

Defense attorneys for Joseph argue the incident was not intentional and described it as a spontaneous act. Martinez’s attorney maintains his client was not involved in the crime.

Court Decision and Next Steps

The judge said she was not legally able to hold the defendants without bond and set bail at $3 million each.

The case is scheduled to go to trial on Nov. 9.
