A Wisconsin man accused in the drowning death of a 13-year-old boy with autism has been found competent to stand trial.
Tylor Birch, 21, appeared in Marinette County court, where both prosecutors and defense attorneys accepted a psychologist’s report determining he is fit to face trial on a charge of reckless homicide.
Details of the Incident
Birch and Peyton Carnot, 16, are accused in the death of Jakob Bowerman.
According to investigators, the two allegedly grabbed Jakob by his hands and feet and swung him off a pier into a lake — despite him expressing that he did not want to go into the water.
After entering the lake, Jakob reportedly told them he could not swim.
Attempted Rescue and Tragic Outcome
Authorities say the defendants attempted to pull Jakob out of the water but were unsuccessful.
He was later recovered and transported to a hospital, where he remained on life support for several days before dying on August 23, 2025. His cause of death was ruled as drowning.
Court Proceedings Moving Forward
Birch had previously been ruled competent, but that finding was challenged by his defense. At the latest hearing, both sides agreed to accept the updated evaluation.
His next court appearance is scheduled for April 30.
Carnot, who is being tried as an adult, is expected back in court on June 4 for a status conference.

Jakob’s mother said her son, who had autism, had experienced bullying in the past and did not know the two defendants prior to the incident.
The case has raised concerns about bullying and the treatment of vulnerable individuals.
